Jessica Lungsford Act Updates 7/16/2007

      Members Cleared to Return To Work
As a result of the changes July 1st in the Jessica Lunsford Act, the School Board reevalueate our Members.  We are working with the company to get everyone back to work as soon as possible.

This Law was supposed to be designed to protect our school children, in turn it  could cost our members their jobs. This new Law gives each School District the ability to disqualify individuals based on their own criteria. It is not being administered justly by
 the School Boards and each School Board has its own guidelines.
            We will update with any new information as soon as we receive it. This was last updated on 07-13-07 at 3:30PM.

  • 01-22-07 CWA Local 3122 was notified of the Supplemental Screening Policy by Roger Puerto (at&t Network General Manager)
  • 01-23-07 Local 3122 requested CWA District 3 file multiple executive level grievances.
  • 01-24-07 Local 3122 members started to be affected.  We again contacted the District Office.  They advised us they were going to meet with the company on this matter on 02-01-07.  Contacted State Representative Julio Robania and ask if him to help.  He advised us on what could be done to change the law, explaining that it may not occur until May 2007.  We requested the guidelines from the county that they were using to disqualify our members.  We advised our members to file grievances on 3 different issues (improper termination, disparity, failure to accommodate)
  • 01-25-07 Julio Robania contacted CWA Local 3122 President Don Abicht, advising him that a Bill had already been put together since I had spoken with him to address our issues with the law.  He also stated many Legislators were trying to get at&t to hold off until this bill could be passed.  The company has not replied.
  • 01-26-07 CWA Local 3122 contacted the ACLU about our issues. Local 3122 mailed all the information we had up to that date surrounding the Act to all the stewards.
  • 01-27-07 Carlene Sawyer from the ACLU contacted CWA Local 3122 President Don Abicht stating she was interested, but would need the members to present their cases in writing to her so she can review.
  • 01-29-07 CWA District 3 continues to try different avenues with the company to no avail.
  • 02-01-07 CWA District 3 met with the company today. 5:00PM no information yet.  At the Membership Meeting State Representative Julio Robania advised us that the legislators had ask at&t to delay any action until June.  
  • 02-02-07 5:00PM CWA District 3 advised us the company is considering some changes, but we do not have any idea what these changes may be.  They hope to have info/decision by the beginning of next week. We are hoping this will be delaying any action by the company until June.
  • 02-05-07 3:00PM The CWA Legal Department at the District Office in Atlanta reviewed the new Florida Senate bill 988 and is urging our members to contact their Legislators and support it. They believe this bill will help our members under the Jessica Lungsford Act.
  • 02-07-07 Talks continued at the District 3 between the Union and the Company. Still no decision from the company on what they are willing to do for our members.  We need to continue to bombard our legislators in Tallahassee with our concerns about this law, and suggest changes that will relieve the problems for our members.

  • 02-09-07 CWA District 3 advised us that the talks with the company  have not broken down over the JLA issues yet, and ask us to be patient until Monday at which time they should have an answer from at&t on if the company is willing to offer any relief for our members.  CWA 3122 would like to help build a support network for those members that have been effected by this law.  Please contact Armando Uranga at the Union Hall if you would like to get involved. 305-232-3122 ext.224
  • 02-12-07 Here is a letter we just received via e-mail from CWA District 3. It appears to us that the company is not willing to work with our members on any of the issues.

    I understand there is a great deal of frustration concerning activities around the Jessica Lunsford Act. I can certainly understand your frustration. We, too, are frustrated.

    I have had numerous conversations with the Company concerning these issues. I have spoken with David Scobey, Bill Smith, and Mike Matthews. Beverly Hicks has also had discussions with Mike Matthews and Salem Shunnarah, and Judy Dennis has had conversations with Salem and John Tragesar.

    I have asked the Company to consider assigning the employees who have not passed the screen to such work as pole transfers, Central Office framework, and assisting in construction operations. I also asked them to let employees remain on their regular jobs and to turn back dispatches that are near a school. We also suggested that they pay employees for a period of time that they are off trying to resolve the issue concerning failing the screen. Although the Company said they would consider these suggestions, they have not yet agreed to any of them. We have followed up on several occasions to remind them that we have employees off the payroll and we need some answers.

    The Company was telling employees who were requesting transfers that they would have to provide information to the selectors as to why they had not passed the screen. We took exception to this practice because we did not believe employees should be giving this information to numerous selectors. The only thing the Company was willing to do was to have the information given to one Labor Relations person. CWA did not agree with this practice either. However, it is our understanding the Company is moving forward in this manner.

    You will be receiving information very shortly concerning a conference call that we will be setting up with all Florida Local Presidents and staff. It is tentatively set for 9:30 a.m. Eastern Time, Wednesday morning. Once we have all of the information, we will get it to you promptly.

    I apologize that we have not been able to resolve these issues. Unfortunately, we do not have control over when the Company responds to us, however, I can assure you we will keep trying.

  • The Miami Dade County School Board Meeting is Wednesday 02-14-07, we are working to have as many people as possible attend to speak about how the School Board's adminstration of the JLA has impacted their lives and families. Contact Armando Uranga ASAP for details. (232-3122  Ext. 224)

  • 02-14-07  We had a State wide conference today with Noah Savant/Beverly Hicks at 9:30am to discuss the JLA and Company proposals.  The CWA Legal Team in Atlanta and Washington explored placing an injunction to try and put everything on hold, but discovered this could not be done.  As the above letter states the District has made many suggestions that would help our members to no avail.  The Comp[any has countered with some noncontractual ideas that are being explored today, all would take a Memorandum of Agreement before they could be tried.  We also were being told that the State Legislator was viewing this as only a at&t/Bellsouth issue. We need everyone to employ all their friends and relatives to call their State Legislators and assure them this is not only going to affect at&t/Bellsouth, But other workers and electionsin the future. 

  •  At 1:00PM today President Don Abicht was on the Ed Shultz Show, a nationally broadcast radio show and spoke to the backlash our members are suffering because of the JLA.  Please make sure you have filed out any grievances surrounding this issue. To listen to the interview Click Here

  •  Don't forget to go to the Miami Dade County Board today, be there at 5:45PM. The address is 1450 N.E. 2nd Ave. 

  • We advised last Friday the ACLU in Orlando called a Press Conference that included some of CWA's affected members.  We are asking the members of our local that are affected to please contact our local ACLU here in Miami.

  • 02-15-07 Last night at the Miami Dade School Board Meeting CWA local Officers and Members expressed their displeasure on how the School Board is administering the JLA.  The School Board was surprised at how our members have been treated under the law.  Three of the Board Members showed compassion and concern about how our members have been harmed, but the School Board Lawyers said that was what the Law called for.  After some debate we found that we my be able to introduce a motion to change the way the School Board is administering the law, that may help some of our members as well as other workers in the County.  The next School Board Meeting is scheduled for Feb. 23, please keep your calendar open so you can attend this meeting in support of your Union Brother and Sisters if needed. 

  • 2-15-07 3:00PM We received a letter from the district clarifying transfers within the State of Florida.

    After the conference call yesterday morning I had further discussions with Mike Mathews concerning the impact of the Act. We again discussed the Company’s policy that disqualifies an employee who has failed the screening in one school district from working anywhere in Florida.

    Following our discussions Mike had further discussions with AT&T Network and Legal. The Company is modifying their policy. They are now going to allow employees who have failed to qualify in one school district to move to another area in Florida, where they are qualified under the terms of the working agreement. This means that these employees should put an Article 10 or Article 12 request to areas where they are qualified to work and the Company will honor the request under the terms of the contract.

    At least this is somewhat of a break through. We still cannot get the Company to agree to let employees who work in multiple school district only be assigned work in the districts where they have passed the screen.

  • 02-22-07 The date we were given for the special School Board Meeting was incorrect. A meeting was convened on 02-21-07, at which we were unable to get on the agenda. Even though we were not in attendance our lawyer is actively working with the individual School Board Members to persuade them to make changes in their screening policy.  The next School Board is scheduled for 03-14-07, unless a special meeting is called to address our issue prior to regular meeting.  Be assured we will advise every Union Member and their families when we may need to show the School Board that we are not going to give up this fight.      

  • An article written by Niala Boodhoo appeared In today's Miami Herald (business section).  The article was very reflective of the injustice our members are having to endure.
  • CWA District 3 is still pursuing an MOA trying to gain some relief for our members affected in florida.

  • 03-06-07 Some relief is on the way, today an MOA was voted on and passed by the CWA Local Presidents in Florida.  Affected employees will be notified as soon as a process is in place (we are being told by certified mail)

    Memorandum of Agreement

    Supplemental Screening

    BellSouth Telecommunications, Inc. (the Company) and the Communications Workers of America (the Union) recognize that employees must comply with the Florida state statute, known as the Jessica Lundsford Act, that requires background screening of all employees who may be required to be on school premises as part of their regular job duties.

    The Company and the Union agree to the following:

    Any employee may, in accordance with the Supplemental Screening policy, take an unpaid absence for up to 90 days and their benefits will remain intact.

    Employees who fail to pass the Supplemental Screening required by this act must cooperate by providing appropriate information required by the Company to assist them before any alternatives are considered.

    No combination of alternatives may extend beyond twelve (12) months from the date the Company is advised that an employee did not pass the screen.

    To protect the employee’s continuity of service with the Company and to allow continued employment while these screening discrepancies are being addressed by the employee, the following alternatives may be offered:

    Employees may be allowed to temporarily transfer to other areas identified by the Company. These employees’ seniority will take precedence over others’ seniority for the purposes of application of Article 12.05C. Such transfers will be reviewed by Labor Relations before such transfers are permitted.

    Or

    If a temporary transfer is not available the employee must use any remaining paid time off while resolving issues identified during the screening process unless they enter they PARTNERSHIP Job Bank as described below before any other alternatives are offered.

    Otherwise at the end of the temporary transfer and / or after the employee exhausts all paid time off:

    The employee may enter the PARTNERSHIP Job Bank for the number of weeks provided in Article 24.05D2, and receive termination pay incrementally while participating in the PARTNERSHIP Job Bank (PJB). The termination pay will be based on Article 8.05 C. The employee may exit the PJB by resolving the issue and returning to their previous position or by being selected for a position that does not require the Screen.

    The PJB is offered as an alternative solely to protect an employee’s service while resolving issues associated with the screening process.

    Employees exiting the PJB and returning to a position must repay the termination pay received while in the PJB in the amount not less than 5% or more than 10% of the basic wage per week per month.

    Or

    Eligible employees may take a Personal Leave of Absence that is unpaid for up to twelve (12) months. At the end of the Personal LOA, employees will be granted termination pay if they are not reengaged by the Company.

    The provisions of this memorandum are not retroactive, and are only effective from the date of the agreement. Anyone affected by the Supplemental Screening requirements who has already exhausted their paid time off will be eligible for the provisions of this agreement. This memorandum does not affect or modify any employee’s rights with respect to the grievance or arbitration process.

    Scope:

    All active employees holding titles in Florida subject to the Supplemental Screening requirements.

    Duration:

    This Memorandum of Agreement is for the life of 2004 BST Working Agreement unless terminated or modified by mutual agreement of the parties.

  • 03-08-07 Since our last visit to the School Board in February our local lawyer has been working with the Miami Dade County School Board on trying to change the guidelines used to disqualify individuals per the Jessica Lundsford Act.  We are hoping the changes will qualify those that were negatively affected.  Be prepared to attend the next School Board Meeting on Wednesday March 14th. Our brothers and sisters need your support, and remember this law in its current state could affect anyone of us at any time. 

  • On Tuesday March 13th at 11:00PM NBC6 will air an interview with some of our members regarding this law, and the way the School Board has administered it.

  • 03-09-07 NBC6 contacted us (CWA 3122) to advise us that the airing of the interview above is tentative and thanked us for our patients.  They may want to wait to see how the School Board is going to act on the JLA Wednesday.  Stay tuned for more info. 

  • We will continue to work to resolve the issues around the Act.
  • 03-14-07 The Miami Dade School Board agreed to reconsider all of our Members that had been previously denied.  This is going to be performed with a 3 member committee to look at each case again, and hopefully treat these cases more with the spirt of the law.

  • On 03-19&20-07 the Locals Legislative Committee and Local President were in Tallahassee speaking with the State Legislators to ensure they would support the changes to the law (SB988) that would take our members off an arbitrary list and get them back to work.  They found that the Senate Bill did not have a Companion Bill in the House of Representatives, and would die in committee with out one, and the deadline had passed for any new bills to be brought forth by any Repersenatives.  However we learned that a Bill could be introduced from a Committee Chair.  At which point we approached Representative Dean who is the Chair of the Kindergarden - Grade 12 where SB988 was about to be heard. We were assured by Rep. Dean's Staff that Rep. Dean would introduce a Companion Bill from the Committee.

  • There is now a Companion Bill to the Senate Bill.  Remember to continue to contact the Legislators to vote in favor on these Bills.

  • 4-05-07 Many of our members are back on the job.  Some of our members have not been cleared in the second appeal, which we do not understand.  We know that if the law changes in July as it is proposed they will no longer be affected.  We would have liked the  Miami Dad School Board to act in unison with that idea, but they did not.  These members may now have to take a temporary transfer, enter the Job Bank, or a leave of absents waiting for the law to change. 

  • 4-18-07  We are still waiting on the Company to grant our members any of the MOA choices they have selected.  The delay appears to be with Gail in Atlanta.

    We, as citizens, as parents, as adults, agree with the premise of the Jessica Lunsford Act: sexual predators must be kept away from our children. Why then does the Act accuse people who have had nothing at all to do with harming children? Why are there different rules in different areas of the state regarding the Act? Why is the State of Florida standing back and allowing injustice, and double jeopardy to cause hardship and job loss for thousands of working middle class men, woman, and families in Florida? It is an outrage that the State of Florida has failed for two years to fix the rule of law to the intent of the Act. Liberty and Justice are at stake for those who have fallen into the cracks of bureaucracy without proper redress. Support the correction of the Jessica Lunsford Act?

  • 04-24-07  As a result of the changes at the School Board many of our members affected by the JLA have now returned to work.  There were some members that were still not cleared with the changes made. (we do no understand why, because when the law changes in July they would be cleared under the new rules anyway) Most of them have been givin one of the MOA options while they address thier issues.  Remember to contact the Local for information on any loss time or wages, we will be handling these concerns through the grievance process.

    SB 988 High-risk Offenders Passes the Florida Legislature

    The Jessica Lunsford Glitch Bill is on its way to Governor’s Desk

    Today Wednesday, May 02, 2007 The Florida House of Representatives called for SB 988 to be read a third and final time. Representative Dean explained the bill there were no questions. There was no debate. The final vote was called and SB 988 passed unanimous. The bill now is headed for the governor’s desk and he can take one of three actions.

    1) Sign the bill into law.

    2) Not sign the bill and after an allotted time let the bill pass into law without his signature.

    3) Veto the bill.

    Call, and Fax preferable to email, a note on a note card is very affective. When a letter is sent it will become part of the record for the substantiation of the governor’s action. This is the very last action our Council will be asking you to take on this issue. There has been no indication by the Governor’s office of a veto however a veto is never off the table, and that is why your final action is so necessary. Y’all have gotten the bill this far and the strides made by your actions are unprecedented. There was no discussion before the final vote on the floor of the House because of all your effort. CWA Council of Florida is so grateful for your persistence. The passage of this bill should help the majority of the members affected.

  • The Governor sign the new Bill on June 20th.  we have contacted our lawyer, and ask him to investigate how the School Board is going to implement the new changes.  There is also a School Board Meeting on July 11th, we my be attending if we do have some answers by the by the 9th of July.

  • 7-13-07  Don Abicht (CWA 3122 President) & Armando Uranga (Executive Vice President) attended the Miami Dade County School Board Meeting on Wednesday 7-11-07, thanking them for their help in the past, and ask the School Board to adopt the changes in the Jessica Lunsford Act ASAP.  The School Board voted to adopt the law, and is going to be reevaluate our effected member first.

There is going to be a CWA Local 3122 Picnic at the Dade County Metro Zoo on May 23, 2010.  All the locals Members and Families are invited to have a great time.  There will be food, refreshments and music for all.  There will be plenty tables to eat at, but there will be lots of room for your lawn chairs and blankets too.  For tickets you can use the order form in the Locals News Letter or click here to download the one on our web site.  We hope to see all of the animals and you at the Zoo.
If you have not purchased tickets by 5-14-2010, and are still interested in attending the picnic you will need to go to the Union Hall in person to get tickets

Honorable Governor Crist,

Thank you for your tireless effort for the betterment of the working families of Florida. I am compelled to write to you for your attention regarding an unintended circumstance taking place.

We, as citizens, as parents, as adults, agree with the premise of the Jessica Lunsford Act: sexual predators must be kept away from our children. Why then does the Act accuse people who have had nothing at all to do with harming children? Why are there different rules in different areas of the state regarding the Act? Why is the State of Florida standing back and allowing injustice, and double jeopardy to cause hardship and job loss for thousands of working middle class men, woman, and families in Florida? It is an outrage that the State of Florida has failed for two years to fix the rule of law to the intent of the Act. Liberty and Justice are at stake for those who have fallen into the cracks of bureaucracy without proper redress. Support the correction of the Jessica Lunsford Act?

Membership Meeting 5/15/2010

 NEW MEETING NIGHT
The Monthly Membership Meetings have been changed to the first Tuesday of each month. You as members are the most valuable part of the Union, and we would like to be able to keep you informed and involved in the decisions that my affect you.  At each Membership Meeting the members in attendance discuss and vote on motions that my concern them.  We would like everyone to have voice at the Union Meeting, and to accomplish this all you have to do is attend.  After each meeting there is Pizza and Refreshments, oh yea! door prizes too. The Meeting are the First Tuesday of the month at 8:00PM.  Hope to see you there, and maybe you will even run into an old friend.

         It was overwhelming to hear the message we sent to the company.  The vote to deny the Premise Tech. was taken at 2:45PM on Thursday Sept. 20, 2007.  The count was 87 to 8, defeating the MOA, and letting the company know that we are not going to forget the passed or give up our future.  Thanks to all the Presidents who followed the wishes of their members to vote this down.

At&t Scholarship Program

The AT&T, CWA, IBEW Academic Awards Program for the 2009/2010 school year is now available for children of employees covered under the Legacy AT&T 2005 AT&T, CWA, IBEW Operations Bargaining Agreements. Applications will be accepted online only at https://www.scholarshipamerica.org/atta. The Company will award 28 new scholarships under the Academic Awards Program for the 2009/2010 school year.  An additional scholarship program is also available for your CWA and IBEW members. Children and step-children of all active AT&T employees may apply to the AT&T Scholarship Foundation Program. Applications for this program will be accepted online only at https://www.scholarshipamerica.org/attfoundation. The Company will award 630 new scholarships under the AT&T Foundation Scholarship Program for the 2009/2010 school year.  Scholarship applicants eligible to participate in the AT&T, CWA, IBEW Academic Awards Program and the AT&T Foundation Scholarship Program may apply to both programs. However, they may receive only one scholarship award. Applicants selected to receive scholarships under both programs will receive a scholarship award from the program that provides the highest award amount.  The application timeframe for both scholarship programs runs from November 1, 2008 through February 15, 2009. Employee Free Choice Act Update 4/10/2009

Momentum continues to grow for the Employee Free Choice Act. In the past two weeks CWA members like you have been hard at work contacting and visiting Congressional offices. The case for this legislation was bolstered by a group of leading economists and a new report from the Center for American Progress. Check out the highlights below.

CWA Members Visit Congressional Offices

Members of Congress were in their home states and districts during the week of February 16th and CWA members were there to meet them. Taking advantage of a scheduled "district work period" which allows legislators time to leave Washington, members from across the country visited their local offices to talk about the Employee Free Choice Act, health care, and other critical items on CWA's legislative agenda.

In Florida, members delivered over 5,000 cards in support of the Employee Free Choice Act as well as nearly 400 handwritten letters to the office of Senator Bill Nelson. During their meeting with an aide to the Senator, they shared their stories and asked for Senator Nelson's support.

In New York, members met with Congressmen Dan Maffi (NY-25), Eric Massa (NY-29) and an aide to Congressman Michael Arcuri (NY-24). All three members have agreed to co-sponsor the Employee Free Choice Act.

Last year thousands of CWA members prepared for the opportunities presented by the 2009 elections by participating in day-long workshops about the Employee Free Choice Act and Health Care. Much of the material they covered is available online at www.freechoicecwa.org and www.healthcarevoices.org .

Leading Economists Advertise Their Support of Employee Free Choice

Last Wednesday, a group of leading economists took out a full page ad in the Washington Post in order to show their support for the Employee Free Choice Act. The ad, sponsored by the Economic Policy Institute, features a powerful statement explaining how the bill will help our economy:

"A rising tide lifts all boats only when labor and management bargain on relatively equal terms. In recent decades, most bargaining power has resided with management. The current recession will further weaken the ability of workers to bargain individually.

"More than ever, workers will need to act together. The Employee Free Choice Act is not a panacea, but it would restore some balance to our labor markets. As economists, we believe this is a critically important step in rebuilding our economy and strengthening our democracy by enhancing the voice of working people in the workplace."

The ad appeared in the Post the day after Barack Obama's first address to Congress, where he outlined the challenges that face our country. President Obama discussed the economic downturn's devastating impact on the middle class, but was also quick to note that America has always responded strongly during difficult times. And as these 40 economists said on Wednesday, there is no better help for the middle class than the passage of the Employee Free Choice Act.

Hundreds Set to Share Their Stories

Next week hundreds of workers will arrive in Washington to tell Members of Congress why we need the Employee Free Choice Act. Most Members of Congress do not have first-hand experience with a union organizing campaign. By sharing their stories about organizing fights, campaigns where they won recognition but failed to get a first contract, and positive majority sign up experiences, these workers will help their elected leaders understand why the system we have now is broken and why the Employee Free Choice Act will make a difference.

Fifteen CWA members are slated to participate, including Heidi Dahms of Maine. Dahms helped bring fairness to her workplace by leading an organizing campaign at Fairpoint Telecom. Dahms knows that the Employee Free Choice Act will give other workers around the country who want to organize a union the same opportunity she and her co-workers have had (see full story below).

'We Need Unions So Workers Like Me Can Live the American Dream'

The backlash began as soon as managers discovered that Vernetta McCray and coworkers at St. John's Community Services-–a residential program serving people with disabilities--wanted to form a union.

"They fired some of my co-workers, pressured others, and threatened to institutionalize our clients," McCray said. "It was an awful experience. I soon learned that our laws did nothing to protect me from management intimidation."

Within a week of launching the organizing drive, 75 percent of workers signed cards seeking a union. While some were frightened away by the company's bitter campaign in the weeks leading to the NLRB election, a majority cast ballots to join CWA Local 1037. The vote, in January 2005, was 33-19.

But their hopes of negotiating better wages and being a collective voice for better patient care were soon dashed. Management appealed the election and dragged its feet at the bargaining table, knowing they could get away with it. Studies show that in one-third of all first contract negotiations, employers refuse to bargain in good faith--if at all.

"St. John's simply refused to negotiate with the union--they cancelled most of the negotiating sessions," CWA Local 1037 Organizing Director Anne Luck said. "This employer knew our labor laws no longer protect workers, and they just took advantage."

The union filed multiple unfair labor practice complaints and the case of one fired worker is still pending at the NLRB in Washington, D.C.

Luck noted that the union has since learned that the non-profit company spent more than four times the amount of money to kill the union than it would have taken to give workers the wage increase the union proposed.

Ultimately, the state of New Jersey didn't renew its contract with St. John's and turned the group homes over to other agencies.

"I am one of thousands of workers who are denied the right to form unions each year," said McCray, who now works for state children's services. "If the Employee Free Choice Act was law, fear could no longer be used as a weapon against workers. We need more unions so more workers like me can live the American dream."

New Center for American Progress Report Shows the Benefits of Union Membership

Last week, the Center for America Progress released a report that shows the positive impact that unions have on working families across the United States. It examines the disparity between productivity and wages that has occurred since the 1980s, and sees a decline in union membership as a likely explanation. Looking at how union membership impacts to the US economy, the report comes to the following conclusion:

"Passing the Employee Free Choice Act and making it harder for management to threaten workers seeking to unionize would be good for American workers. It would help boost workers' wages and benefits. And putting more money in workers' pockets would provide a needed boost for the U.S.economy. Increasing unionization is a good way to get out of our current economic troubles."

Contract negotiations between CWA and AT&T  resumed on July 20th.  There are numerous issues on the bargaining table; this round of negotiations will be extremely crucial to all of us as a Union.  AT&T is a profitable company thanks to your hard work.  In return, we all want a fair and equitable contract that provides improvements in wages, benefits and some other conditions of employment. 

 

In the event of a strike your local Union will pay strikers $1.00 over minimum wage for a minimum of 10 hours and a maximum of 30 hours for strike duties per week.  Currently, the Locals Strikers Assistance fund has a balance of nearly $400,000.

 

 On the National level, the CWA Members’ Relief Fund provides a striker benefit of $200.00 per week beginning with the 15th day of a strike and $300.00 per week beginning with the 29th day (this will be in addition to the local strike relief money paid).   The CWA Members’ Relief Fund is extremely healthy.  It currently has a balance of nearly $400 million dollars, should a strike become necessary.  The Members Relief fund requires every striker to perform strike duty in order to receive payments from the fund.   

 

The Members’ Relief Fund will also insure that necessary medical and dental care will be provided to you and your dependents in the event of a strike extending beyond August 31st at which time our medical benefits would not be covered by AT&T.  In some extreme cases the Union will pay your medical premiums rather than reimburse you for “necessary” medical/ dental care.  If you or one of your dependents has some ongoing or serious medical need, you must contact the Local’s COBRA Coordinator, Sherri Perez as soon as possible at (305) 232-3122 ext. 243.

Misleading Reports on Employer-Sponsored Benefits

Recent reports in the business press about AT&T and Verizon considering dropping employer-sponsored benefits are misleading.  A recent article in Fortune suggests that AT&T and Verizon, among other employers thought about dropping benefits and instead paying a penalty that would be required under the new health care reform law. 

The first thing to keep in mind is that our negotiated benefits are protected by the collective bargaining agreement and the company cannot unilaterally change the benefits.  CWA has not and will not agree to the company dismantling the employee health benefits package we have built over decades.

Upon reading, you will see that the article does not base its conclusions on any direct interview or testimony by company representatives.  Instead, it is based on documents provided to the Energy and Commerce Committee when it was planning a hearing on the impact of health care reform on large businesses.  Both AT&T and Verizon, along with other companies, had been asked to testify and submit documents.  The documents included PowerPoints and other presentations by consultants and others analyzing the impact of the new health care reform law on the particular employers. 

A Republican Energy and Commerce Committee staffer posted the documents to their website without permission and without explanation from the companies.  However, the Minority Staff did post their own interpretation of the documents which were included in a memo dated April 27, 2010.  So, it appears that the background documents and a memo drafted by Republicans were the basis of the article. 

We have requested that AT&T issue a clear statement of their continued commitment both to quality benefit plans and collective bargaining.  We hope that they make a statement soon in order to clarify this partisan attempt at misinformation.

2011 and 2012 Medical Benefit Changes for Active Employees

When you get your open enrollment package for 2011 and 2012 open and read it carefully there will be changes in it. DO NOT GET CAUGHT BY SUPRPRSE.

There will be a premium of $10 for Individual coverage and $25 for Family coverage for in 2011. In 2012 the premiums will be $35 for Individual and $75 for Family. These premiums will be for the PPO and POS plans. For Bapco and Utility’s the premiums will be $35 for Individual and $75 for Family in 2011 and 2012. No premiums were anticipated for the HMO plans or EPO plans, but CHECK YOUR OPEN ENROLLMENT PACKAGES

No Change in the Active Part-time monthly contributions.

In 2011 and 2012 the Spousal Carve-out premium will be eliminated. Employees will be allowed to cover his/her spouse under the family premium.

Preventive Care

Preventive Care will be covered at 100%, (No copays, no deductibles, no coinsurance payments) as long as you use network providers.

Preventive care services are generally linked to routine wellness exams, while nonpreventive services are considered treatment or diagnosis for an existing illness, injury or condition.

Examples of preventive care:

Annual routine physicals Pap smears

Cholesterol screenings Mammograms

Colonoscopies Some immunizations

This isn’t a comprehensive list. Check with your medical insurance carrier for what they consider Preventive Care.

Deductibles and Out of Pocket Maximums

An In-Network deductible of $350 for Individual and $ 700 for Family will be in effect for the life of this agreement

There will be a Co-insurance (excluding preventive care) of 10% for In-Network and 40% for Out of Network Co-insurance is the percentage of charges you pay for covered services, in addition to any applicable deductible.

Out of Pocket Maximums: In Network $1000 Individual/ $3000 Family

Out of Network $3000 Individual/ $6000 Family

Individual basis for deductibles and out of pocket maximums—the family out of pocket maximum is met once any combination of covered persons’ coinsurance meets the family out of pocket maximum amount.

  • HOW THIS WILL WORK
    1. Individual- He/she goes to the doctor, and pays the full doctor bill until he/she reaches his $350 deductible. From this point on when he/she has any type of medical care he/she pays 10% coinsurance of the negotiated rate of the medical bill. Once he/she pays the out of pocket maximum of $1000, now the company pays 100% of the medical claims.
    2. Family of 2—Husband and wife - Wife has a lot of medical problems and reaches a deductible of $350 first, she will then go to only paying 10% coinsurance of the negotiated rate of the medical bill. The wife continues on and reaches the individual out of pocket maximum of $1000, now the company pays 100% of the medical claims. The husband still has not reached the $350 deductible so is still paying 100% of his doctor visits. He has reached his deductible and is now paying 10% coinsurance, once he reaches the $1000 out of pocket maximum all his medical claims will be paid at 100% by the company like his wife’s.

3. Family of 3—Husband, wife and child-no one in the family as any major medical problems, they all combine reach the $700 family deductible, and move to the 10% coinsurance, since none of them reach the individual out of pocket $1000 they all together reach the $3000 out of pocket maximum together to move to the level were the company will pay 100% of their medical claims.

PRESCRIPTION COVERAGE
OUT OF POCKET MAXIMUMS

There is an Out of Pocket Maximum of $900 Individual and $1,800 Family. These rates are for the life of this contract.

Out of Pocket Maximum provisions:

  • Only applies to Network prescriptions drug copays
  • The amount that is applied to the out of pocket maximum is the network prescription drug copay
  • With Family coverage a covered person has satisfied the out of pocket maximum once their copays satisfy the individual out of pocket maximum amount. The family out of pocket maximum is met once any combination of covered person’s prescription drug copays meets the family out of pocket maximum amount. It is not necessary that any one individual reach the individual out of pocket maximum amount, but no one individual may contribute more than the individual out of pocket maximum amount.

As of 2011 we will no long be able to get a 60 day prescription, you will only be able to get 30 days or 90 days.

In 2011 and 2012 you may use mail order through CVS Caremark or you may pick up your 90 day prescription at any CVS pharmacies for the mail order copay.

OTHER CHANGES WITH PRESCRIPTIONS

Maintenance prescriptions will be required to go from 30 day supplies to 90 day supplies (mail order) after the second refill at a retail store.

Personal Choice Drugs will no longer be covered under the plan the participant will have to pay 100% (example: anti-wrinkle injections, erectile dysfunction agents, hair-growth agents, hair removal agents, topical anti-aging agents and fertility and diet medications.

Mandatory Generic-if a generic drug is available and you opt for the brand name equivalent, you will pay the generic copay plus the difference in the cost between the generic drug and the brand name drug you selected. This applies regardless of your reason for not using the generic drug or if your doctor has written dispense as written on the prescription or no substitution.

CAREPLUS

This is a new option open to the Southeast for the first time during the 2011 open enrollment. This will be a supplemental coverage that will cover specific medical treatments (mostly cancer) that are not covered under you normal health care plans. You will be receiving more information about this plan during the year and at open enrollment so you can make an informed decision about this product. The charge for this coverage is projected to be $1.00 Individual and $2.00 Family. There is some information about this on the web.
